A Vancouver woman was allegedly struck in the face with a golf ball that came flying through her open car window while driving along Oak Bay’s Beach Drive in June.
Now, Evelyn Mohr is suing the District of Oak Bay, The Victoria Golf Club and Kane Watt, the man who reportedly hit the wayward ball.
Mohr filed a civil claim on Feb. 29, stating she was driving her car in a “safe and prudent manner” when a ball hit her in the face causing severe injuries. It is alleged that Watt, a member of the club at the time, was responsible for striking the ball.
She claims to have suffered from facial lacerations, headaches, concussion, and injuries to the eye, cheek and forehead, among other ailments. The suit claims Mohr has lost enjoyment of life, earnings, and the opportunity to earn income, and that she now has a shortened working life.
The civil suit claims the golf course was designed in a way that posed a risk, and that the club and the District of Oak Bay failed to protect or warn people of the dangers.
It also claims the defendants were negligent in ensuring she or anyone else would not be injured by a golf ball and seeks general, special and aggravated damages from all three defendants..
Neither the district, the golf club nor Watt have filed a response to this civil suit and will not comment as the matter is before the courts.
None of the accusations have been proven in court.
