Bylaw Nos. 2099 & 2100

February 21, 2023, 6:00pm

Pursuant to Section 466 of the Local Government Act, we advise you that a Public Hearing has been scheduled to consider these amendments to the Zoning Bylaw. Anyone who considers their interest in property to be affected by the proposed Bylaws will be given reasonable opportunity to be heard.

Subject Property

Bylaw No. 2099 will apply to all properties in the Town of Ladysmith where a caretaker dwelling is permitted or where a dwelling unit is permitted but has a minimum finished floor area restriction.

Bylaw No. 2100 will apply to all properties in the Town of Ladysmith where coach houses, accessory buildings, or secondary suites are permitted.

What is the Proposal About?

If approved, Bylaw No. 2099 will amend Town of Ladysmith Zoning Bylaw 2014, No. 1860 by:

  • Removing the minimum finished floor area restriction for dwelling units from all zones where this regulation exists.
  • Revising the floor area regulations for caretaker dwellings.

If approved, Bylaw No. 2100 will amend Town of Ladysmith Zoning Bylaw 2014, No. 1860 by:

  • Revising regulations pertaining to coach houses including:

  o Removing the requirement that a coach house dwelling be fully contained on the second storey where it is within a two-storey building.

  o Adding an exemption from parcel coverage for garages where a coach house 5m tall or less is located on the property.

  o Removing the requirement that coach houses comply with accessory building regulations, except for the accessory building number calculation (see point below).

  o Clarifying how the number of accessory buildings on a property is calculated when a two-storey coach house is located on the property.

  o Removing references to coach houses from regulations pertaining to accessory buildings.

  o Changing how gross floor area is calculated in a coach house.

  o Reducing the minimum parcel area required to permit a coach house from 660m2 to 550m2 where a parcel abuts a lane; from 668m2 to 550m2 where a parcel is on a corner; and from 780m2 to 668m2 for all other parcels. o Clarifying that a coach house is permitted accessory to a live/work unit or a single unit dwelling.

  o Removing the minimum roof pitch regulation for a two-storey coach house.

  o Allowing coach houses to be located in a side yard.

  o Requiring a 2m interior side yard setback for coach houses taller than 5m.

  • Revising the secondary suite regulations including:

  o Allowing secondary suites to be larger than 40% of the single unit dwelling gross floor area.

  o Removing size restrictions for secondary suites from the R-2, R-2-A and R-2-LW zones.

  • Revising section headings for clarity.

A copy of the proposed Bylaws and related information may be viewed at the Town of Ladysmith City Hall located at 410 Esplanade or the Development Services Office located at 132C Roberts Street, Ladysmith, BC, until February 21, 2023. Office hours are Monday to Friday 8:30am to 4:00pm, excluding statutory holidays. The Proposed Bylaws are also available at www.ladysmith.ca/publichearings.

How do I Attend the Virtual Meeting?

Anyone may attend the meeting. The meeting will be held on February 21, 2023 at the Ladysmith Seniors’ Centre, 630 2nd Avenue, Ladysmith, beginning at 6:00pm.

How Do I Make a Written Submission?

If you are unable to attend the Public Hearing, written submissions can also be provided. If received by Noon, February 21, 2023, written submissions will be included in the Public Hearing agenda. Written submissions should be sent to Town of Ladysmith, PO Box 220, Ladysmith, BC V9G 1A2 or by Email to info@ladysmith.ca. Written submissions can be accepted at the Public Hearing up to the close of the Public Hearing. Please be advised that the content of submissions will be made public and form a part of the public record for this hearing.
