Zoning Bylaw Amendment

Bylaw No. 2163

Pursuant to Section 467 of the Local Government Act, we advise that Council will consider first reading of “Town of Ladysmith Zoning Bylaw 2014, No. 1860, Amendment Bylaw 2023, No. 2163” on January 9, 2024. A public hearing will not be held for the proposed bylaw.

Subject Properties

The proposed zoning amendments will apply to all properties currently zoned Downtown Commercial (C-2) and Live/Work Residential (R-2-LW) and properties in the Downtown currently zoned Highway Service Commercial (C-3).

What is the Proposal About?

If approved, Bylaw No. 2163 will:

1. Rezone all Downtown properties currently zoned R-2-LW and C-3 to C-2;

2. Amend the C-2 zone to:

  a. Allow ‘Dwelling Unit’ and ‘Bed and Breakfast’ as permitted principle uses.

  b. Allow ‘Gas Bar’, ‘Service Station’ ‘Two Unit Dwelling’ and ‘Motor Vehicle Body Shop’ lawfully constructed prior to December 19, 2023, as permitted principle uses.

  c. Allow ‘Secondary Suite’, ‘Coach House Dwelling’, ‘Urban Agriculture’ and ‘Vehicle Sales or Rental’ lawfully constructed prior to December 19, 2023, as permitted accessory uses.

  d. Increase the maximum Floor Space Ratio from 1.0 to 3.0 for parcels fronting 1st Avenue and 3.3 for all other parcels in the C-2 Zone.

  e. Delete subsection 11.2(4)(a) which limits the maximum number of dwelling units on a parcel to 75 units per hectare of land.

  f. Increase the maximum parcel coverage from 75% to 100%.

  g. Increase the maximum permitted height of a principle building from 12 meters to 18 meters for parcels that front 1st Avenue and 21 meters for all other parcels in the C-2 Zone.

  h. Reduce the rear yard setback from 3.0 meters to 0 meters.

  i. Add new front and exterior side yard setbacks for the 4th, 5th and 6th storeys of a principle building as follows:

  i. 4th Storey 2.7 meters

  ii. 5th Storey 5.4 meters

  iii. 6th Storey 8.1 meters

Office hours are Monday to Friday 8:30am to 4:00pm, excluding statutory holidays. Please note, City Hall and Development Services will also be closed from 2pm on December 22, 2023, until 8:30 am on January 2, 2024.
